1. General

Welcome to AdriaMart.com (hereinafter referred to as “the Website”). By accessing, registering, placing orders, or using any services provided by the Website, you acknowledge that you have read, understood, and agreed to these Terms & Conditions (hereinafter referred to as “the Terms”). If you do not agree, please stop using the Website immediately.

2. Definitions

  2. User: Any individual or entity who registers, browses, places an order, or uses services on the Website.

  5. Products: Items displayed and available for purchase on the Website.

4. Orders and Contract Formation

  1. An order placed and successfully paid by the User constitutes a legally binding sales contract.
  2. The Website will confirm the order and arrange shipment as soon as possible.
  3. If an order cannot be fulfilled due to insufficient stock or other reasons, the Website reserves the right to cancel the order, notify the User, and issue a refund.

5. Pricing and Payment

  1. Product prices are based on the prices displayed on the Website at the time of order.
  2. Whether taxes are included will be clearly indicated during checkout.
  3. Accepted payment methods include (but are not limited to): bank cards, e-wallets, bank transfers, and cash on delivery (where applicable).
  4. All online payments are processed through secure and PCI-DSS compliant payment gateways.

6. Delivery and Shipping

  1. The Website will arrange shipment after confirming the order. Delivery time depends on logistics.
  2. The risk of loss and ownership of the goods transfer to the Buyer upon receipt.
  3. The Company shall not be held liable for delays caused by force majeure or third parties but will assist in resolving the issue.
  4. Deliveries are handled by authorized logistics partners such as Post Express, D Express, or other certified couriers.

7. Returns and Refunds

  1. In accordance with Serbian and EU consumer protection laws, Buyers have the right to withdraw from the purchase within 14 days without giving any reason (cooling-off period).
  2. Returned products must be intact, unused, undamaged, and accompanied by original packaging, accessories, and invoice.

  3. Exceptions (non-returnable items):

    • Customized or made-to-order products;
    • Perishable goods or items with a short shelf life;
    • Hygiene, health, or media products once unsealed.
  4. Buyers may also request a return or replacement in case of damaged goods, wrong items, or quality issues.
  5. Refunds will be issued within 14 days after the Seller confirms receipt of the returned goods.
  6. To initiate a return, Buyers should contact Customer Service at [email protected] before sending any items back.

8. User Obligations

  1. Users must provide accurate and complete personal details, shipping address, and contact information.
  2. Users are responsible for any losses resulting from inaccurate or incomplete information.
  3. Users must not engage in fraudulent orders, abuse of return rights, or any illegal activity.

9. Platform Liability and Disclaimer

  1. Where goods are supplied by third-party Sellers, the Website acts only as a platform and is not directly responsible for product quality or descriptions.
  2. The Website will provide reasonable support to Buyers in disputes with third-party Sellers.
  3. The Company reserves the right to modify, suspend, or terminate any part of the Website services at any time.
  4. AdriaMart acts solely as an intermediary platform and does not own or directly sell products unless explicitly stated.

10. Intellectual Property

  1. The Website’s logo, product images, descriptions, and page design are protected by intellectual property laws.
  2. No individual or organization may copy, distribute, or use such content for commercial purposes without written permission.

11. Privacy and Data Protection

  1. The Company complies with GDPR (General Data Protection Regulation) and Serbian data protection laws.
  2. The Company only collects information necessary for order processing (e.g., name, address, contact details, payment information).
  3. User data is kept confidential and used solely for order fulfillment, customer service, and lawful marketing activities.
  4. Data will not be disclosed to third parties unless required by law or with the User’s consent.

12. Governing Law and Dispute Resolution

  1. These Terms are governed by Serbian law.
  2. Any disputes shall first be resolved amicably; failing that, disputes shall be submitted to the competent courts of Belgrade, Serbia.
  3. Users may also file complaints with the Serbian Consumer Protection Organization.
  4. In case of any discrepancies between language versions, the Serbian version shall prevail.
