Adriamart.com Terms and Conditions

1. Nature of Service and Definitions
Adriamart.com (hereinafter referred to as the “Platform”) is an online information society service platform that provides product display and order-matching technology services. The Platform itself is not the seller of goods nor a direct party to any transaction.
For the purposes of these Terms, “Merchants” are independent legal entities registered on the Platform that directly sell their products to customers. All products are sold directly by Merchants to customers.
2. Orders and Invoices
Orders placed by customers through the Platform constitute a sales contract between the customer and the respective Merchant.
All invoices are issued by Merchants directly to customers in accordance with applicable Serbian tax laws and regulations. The Platform does not undertake any invoicing obligations.
3. Prices and Payment
Product prices are set solely by the Merchants and displayed on the Platform.
Payment terms and methods are determined and executed by the Merchants.
4. Delivery and Transfer of Risk
Products are shipped directly by the Merchants.
Ownership and risk of the products transfer from the Merchant to the customer upon delivery to the carrier or the customer, whichever occurs first.
5. After-Sales Service and Returns
Any issues related to product quality, quantity, delivery, or returns must be resolved directly between the customer and the Merchant.
As an intermediary service provider, the Platform may offer reasonable coordination assistance but assumes no direct or joint liability for products sold by Merchants.
6. Limitation of Liability
The Platform makes no express or implied warranties regarding the quality, suitability, legality, or compliance of products sold by Merchants.
The Platform’s responsibility is strictly limited to providing technical support and order-matching services, in accordance with the Serbian Law on Electronic Commerce, the Consumer Protection Law, and related regulations.
7. Governing Law and Dispute Resolution
These Terms, their validity, performance, and dispute resolution shall be governed by the laws of the Republic of Serbia.
In the event of a dispute arising under these Terms, the parties shall first attempt to resolve the matter amicably. If no resolution is reached, either party may submit the dispute to the competent court in Belgrade.
